Introduction
These Terms and Conditions govern the relationship between Cribbo Technologies Inc. (“Cribbo,” “we,” “our,” or “us”) and any User accessing or utilizing Cribbo’s platform, including Landlords, Tenants, and agents (collectively, “you,” “Landlord,” “Tenant,” or “agent”). Your use of Cribbo’s services—including the, Background and Credit Check Report —constitutes your agreement to these Terms and Conditions, the Privacy Policy, and all applicable laws and regulations. Cribbo reserves the right to modify, update, or remove any portion of these Terms and Conditions at any time without notice.
1. Cribbo Services
1.1 Credit and Background Check Reports
• Data Sources: Cribbo generates reports based on information provided by Users and data from third-party agencies (e.g., credit history, court records, and employment verification). Reports comply with Canadian privacy laws, including PIPEDA, B.C. PIPA, and A.B. PIPA.
• Landlords and Agents Consent Requirements: Landlords and Agents must obtain written consent from Applicants before requesting a report. Consent is demonstrated through selection of “YES” on our website. Proof of consent may be requested by Cribbo or its partners at any time.
• Payments must be made before a report is processed. Reports are intended to provide guidance and not serve as the sole basis for decision- making.
2. User Obligations
2.1 Account Creation and Use
• Data Security: Users must safeguard private data and limit account access to authorized individuals (Permitted Users). Misuse or unauthorized access must be reported immediately.
• Compliance: Users must comply with all applicable laws and obtain required consents before using Cribbo Services.
2.2 Prohibited Activities
Users agree not to:
• Misuse Cribbo Services for fraudulent, illegal, or unauthorized purposes.
• Tamper with or reverse-engineer Cribbo’s platform.
• Infringe on third-party intellectual property rights.
• Engage in activities that impair Cribbo’s operations or violate applicable laws.
3. Intellectual Property and Data Rights
• Ownership: All content on the Cribbo website, including text, graphics, and software, is owned by Cribbo and protected by intellectual property laws. Users are granted a limited, non- transferable license to access Cribbo Services.
• User Data: Users retain ownership of data they input but grant Cribbo a royalty-free license to use and process such data for service delivery and improvement.
4. Limitation of Liability and Disclaimers
• Accuracy of Reports: Cribbo relies on third-party data providers and is not responsible for inaccuracies in reports. Users must address disputes directly with the respective agencies.
• Service Availability: Cribbo does not guarantee uninterrupted or error-free operation of its services.
• Liability Cap: Cribbo’s total liability to any User will not exceed the fees paid to Cribbo within the one month prior to the claim.
5. General Provisions
5.1 Governing Law
These Terms are governed by the laws of Ontario and Canada. Disputes will be resolved exclusively in Ontario courts.
5.2 Force Majeure
Cribbo is not liable for service interruptions caused by events beyond its control, including natural disasters, acts of government, or technical failures.
5.3 Severability
If any provision of these Terms is deemed invalid, the remaining provisions will remain in full effect.
5.4 Entire Agreement
These Terms, together with the Privacy Policy and Tenant Services Agreement, constitute the entire agreement between Users and Cribbo.
